Queensland Form 2 seller disclosure

The mandatory seller disclosure framework began on 1 August 2025. Here is what sellers should discuss with their solicitor before signing a contract.

What changed on 1 August 2025?

Queensland introduced a mandatory seller disclosure scheme under the Property Law Act 2023. For most relevant property sales, sellers must give buyers the completed seller disclosure statement, known as Form 2, along with prescribed certificates before the buyer signs the sale contract. Different rules and exceptions can apply.

What kinds of information are involved?

The required documents can cover title and survey details, certain property notices, and for properties in a community titles scheme, the relevant community management and body corporate information. The exact requirements depend on the property.

When should you start?

Early. Obtaining searches, records and certificates can affect the campaign timetable. This is especially relevant for apartments and townhouses with body corporate documents and for estates or sales involving another authorised person.

Does Form 2 cover every possible property issue?

No. The official form explicitly warns that it does not include every matter that could affect a buyer, such as structural soundness, flood history and past building approvals. Sellers and buyers should obtain professional advice and conduct appropriate due diligence.
